Senate passes it's version of the CPSC Reform Act H.R. 4040. The bill contains several provisions that remain of concern to the industry.
•Increasing civil penalties from $1.8 million to $20 million;
•Creation of a public database of complaints by customers and other third parties that could contain inaccurate and unsubstantiated disparaging remarks about your products along with sensitive information;
•Weakening of federal preemption provisions that shield manufacturers from inconsistent state safety standards;
•Allowing greater authority for state attorneys general to interpret and enforce federal CPSC FR and other standards;
•Allowing employees to become "bounty hunters" by reporting perceived safety violations to the CPSC and allowing them to possibly collect compensatory damages
